TERMS AND CONDIDTIONS
THINGS YOU NEED TO KNOW
COPY RIGHT, ORDERING , LIABILITY, & POLICIES
EXCULSIVE PHOTOGRAPHER
The Photographer shall be the exclusive photographer retained by the Client for the purpose of photographing the event. Guests, Family and friends of the Client shall be permitted to photograph as long as they shall not interfere with the Photographer’s duties.
COPY RIGHT & REPRODUCTION
The Photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions. The Photographer shall only make reproductions for the Client or for the Photographer’s portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, editorial use, website, or for display within or on the outside of the Photographer’s studio. If the client wishes to reorder a print(s), it may be done within a 6 month period.
CILIENT'S USAGE
The Client is obtaining prints for personal use only, and shall not sell said prints. If Client is obtaining a print for newspaper announcement of the wedding, editorial use or website, Photographer authorizes Client to reproduce the print in this manner. In such event, Client shall run a credit for the Photographer adjacent to the photograph.
FALIURE TO PERFORM
If the Photographer cannot perform this Agreement due to a fire or other casualty, bad memory card or back up, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness, then the Photographer shall return the deposit to the Client but shall have no further liability with respect to the Agreement.
INHERENT QUALITIES
Client is aware that color dyes in photography may fade or discolor over time due to the inherent qualities of dyes as well as DVD or CD media which may deteriorate due to delamination and oxidation, and Client releases Photographer from any liability for any claims whatsoever based upon the deterioration due to such inherent qualities.
PHOTOGRAPHER'S STANDARD PRICE LIST
The charges in this Agreement are based on the Photographer’s Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.
DEPOSIT & PAYMENT
The Client shall make a deposit to retain the Photographer to perform the services specified herein. At such time as this order is completed, the deposit shall be applied to reduce the total cost and Client shall pay the balance due. Balance shall be paid in full during or before the event for the service to be provided. The form of payment(s) accepted by Jenn Thomas Photography will be check made out to Jennifer Thomas or cash in the exact amount. No change is carried at the time of service.
DELIVERY/PICK UP OF PRODUCTS
Items ordered throught the photographer shall be ready for pick between 2-4 weeks from the location used, unless other wise. Addition shipping fees may apply, if shipping is needed. Once photos are received by the photographer, an email will be sent to make you aware of the product ordered.
POST PRODUCTION & EDITING
The final post production and editing styles, effects, and overall look of the images are left to the discretion of the JENN THOMAS PHOTOGRAPHY.
LIABILTY & LIMITATIONS
This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer or Jenn Thomas Photography shall not be LIABLE or SUED for any amount in excess of the retail value of the Client’s order.
The Client also allows all forms of liability and the Client pledges not to SUE the Photographer or Jenn Thomas Photography for any and all claims of inattentiveness by the photographer or Jenn Thomas Photography creating any inconvenience(s) the Client may suffer from such as; economic change, illness, damages, physical damage or injury, even causing psychological impairment.
In the unlikely event that the photographer is unable to perform to the guidelines of this contract due to an injury, illness, act of God, act of terrorism, or other cause beyond the control of Jenn Thomas Photography, will make every effort to secure a replacement. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the EVENT(S).
In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond the photographers control, including but not limited to camera, hard drive, or equipment malfunction, the photographer liability is limited to the return of all payments received for the EVENT(S). The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. The photographer is not liable for the loss of images beyond the lesser of the final delivery of all products included in the package or 6 months.
AGREEMENT TO CONDITIONS
By purchasing services and photographs from JENN THOMAS PHOTOGRAPHY, you (the client) agree and approve to the listed terms and conditions above in the policies stated.
